These Terms of Use, together with any policies or additional terms referenced in them, govern your access to and use of the Trouvaille Med Spa websites, online store, content, features, forms, communications, and other online services that link to these Terms (collectively, the “Services”).

Please read these Terms carefully. By accessing or using the Services, creating an account, submitting content, or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

Who We Are

For purposes of these Terms, “Trouvaille Med Spa,” “we,” “us,” and “our” refer to Chicago Center for Facial Plastic Surgery, S.C., d/b/a Trouvaille Med Spa.

Services Covered by These Terms

These Terms apply to https://www.trouvailleillinois.com/, any clinic online store that links to these Terms, and related pages, features, content, communications, forms, reviews, booking links, product pages, and customer-support interactions.

These Terms govern online Services. They do not replace treatment consents, medical intake forms, financial policies, appointment or cancellation policies, membership or package terms, informed-consent documents, or other clinic-specific documents that apply to consultations, treatments, procedures, or in-person services. The more specific clinic document controls for the matter it addresses.

Other Policies

Your use of the Services may also be subject to our Privacy Policy, Notice of Privacy Practices, Accessibility Statement, Shipping Policy, Refund Policy, promotional terms, membership or package terms, and other terms made available to you. If there is a conflict, the more specific policy or term controls for the relevant feature, offer, product, service, or transaction.

Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction, whichever is older, to create an account or make purchases through the Services unless a parent or legal guardian acts where permitted. By using the Services or placing an order, you represent that you have legal capacity to enter these Terms. If you use the Services on behalf of another person or organization, you represent that you have authority to do so.

Accounts and Account Security

You agree to provide accurate, current, and complete information and keep it up to date. You are responsible for protecting account credentials and should notify us promptly if you believe an account has been accessed without authorization. Product Information and No Medical Advice

The Services may provide information about skincare, cosmetic products, ingredients, routines, aesthetic services, or related topics. This information is general and is not medical advice, diagnosis, treatment, or a substitute for advice from a qualified health care professional. Products are not intended to diagnose, treat, cure, or prevent disease except to the extent expressly stated and permitted by law. Individual results vary. Read and follow labels, warnings, precautions, ingredient lists, and manufacturer instructions.

Consult a qualified health care professional before using a product if you have a medical condition, take medication, are pregnant or nursing, have allergies or sensitivities, recently received aesthetic treatment, or have questions about suitability. Stop use and seek appropriate advice if you experience an adverse reaction.

Trouvaille Med Spa does not provide emergency medical services through the Services. If you believe you are experiencing a medical emergency, call 911 or local emergency services immediately.

Clinic Services and Clinic-Related Information

The Services may describe consultations, treatments, procedures, booking tools, patient resources, or clinic content. Online information does not create a patient-provider relationship and does not replace clinical judgment, individualized medical advice, treatment consent, or clinic policies. Appointment scheduling, cancellations, treatment decisions, payments, refunds, and related matters are governed by the specific clinic documents and communications that apply to the service.

Orders, Payment, and Acceptance

Placing an order is an offer to purchase. An automated confirmation does not necessarily mean an order has been accepted. We may accept, decline, cancel, or limit an order for a lawful reason, including unavailability, inaccurate information, pricing error, payment failure, suspected fraud, shipping limits, or inconsistency with these Terms.

Prices, promotions, availability, shipping options, taxes, and fees may change without notice, subject to law. Unless stated otherwise, prices are in U.S. dollars. You are responsible for charges disclosed at checkout. Third-party payment and fulfillment providers may process transactions subject to their own terms and policies.

Products are for personal, non-commercial use unless we give written permission. We may limit quantities, refuse or cancel orders, or suspend accounts if we believe products are being purchased for unauthorized resale, distribution, or export.

Promotions, Discounts, Gift Cards, and Offers

Promotions, discounts, gifts with purchase, coupon codes, gift cards, memberships, packages, and other incentives may have additional terms, eligibility requirements, exclusions, expiration dates, quantity limits, cancellation rules, and availability limits. Unless the specific offer says otherwise, offers cannot be combined, are not transferable, and may be changed or discontinued subject to law. The specific promotional or program terms control if they conflict with these Terms.

Shipping, Returns, and Refunds

Shipping, returns, exchanges, refunds, damaged items, lost packages, order issues, and related matters are governed by the Shipping Policy and Refund Policy linked from the applicable online store. Review them before ordering. Unless required by law or stated in the applicable policy, shipping, handling, duties, taxes, and similar charges may not be refundable. Available refunds are generally returned to the original payment method.

User Content, Reviews, and Submissions

The Services may allow reviews, ratings, comments, photographs, videos, testimonials, questions, suggestions, feedback, or other content (“User Content”). You are responsible for your User Content. By submitting it, you represent that you have the needed rights; it is accurate and reflects your genuine experience; any material incentive is clearly disclosed; and it does not violate law or another person’s intellectual property, privacy, publicity, contractual, or other rights.

By submitting User Content, you grant Trouvaille Med Spa, its affiliates, service providers, successors, licensees, and assigns a worldwide, non-exclusive, royalty-free, sublicensable, transferable, perpetual, and irrevocable license to use, reproduce, display, distribute, publish, modify, adapt, translate, and create derivative works from that User Content in any media, subject to applicable law. This clause does not replace any separate authorization required to use protected health information, treatment images, or identifiable patient testimonials. We may review, edit, remove, or refuse User Content and do not endorse User Content submitted by others.

Acceptable Use

You may not misuse the Services or help anyone else do so. You agree not to:

• Violate law or a third party’s rights
• Use the Services for fraudulent, deceptive, harmful, or unauthorized purposes
• Disrupt the Services, security features, networks, or other users
• Attempt unauthorized access to accounts, systems, data, or networks
• Introduce malware or harmful code
• Scrape, crawl, harvest, copy, or extract data except as permitted by law or written permission
• Use bots or automated tools in a manner exceeding ordinary personal use
• Impersonate another person or misrepresent identity or affiliation
• Send spam or unauthorized communications or collect personal information without permission
• Use Services content or data to develop or train artificial intelligence or machine-learning systems without written permission, except where the restriction is prohibited by law

Intellectual Property

The Services, including text, graphics, photographs, videos, logos, trademarks, designs, software, code, and features, are owned by or licensed to Trouvaille Med Spa, Chicago Center for Facial Plastic Surgery, S.C., Vos Collection entities, or their respective licensors and are protected by law. Subject to these Terms, we grant a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. No right to use any trademark or brand element is granted without written permission.

Third-Party Links and Services

The Services may link to or integrate with third-party platforms, payment providers, social media, booking tools, shipping providers, or other services we do not control. Links are provided for convenience and do not mean endorsement. Third-party services may have separate terms and privacy policies. We are not responsible for their content, products, practices, security, or availability.

Privacy

Our Privacy Policy explains how personal information is collected, used, disclosed, retained, and protected in connection with the Services. Protected health information is governed by our Notice of Privacy Practices and applicable law. These Terms do not create consent or authorization where separate consent or authorization is required.

Electronic Communications and SMS

When you use the Services, place an order, submit a form, or contact us electronically, you consent to receive transactional and administrative communications electronically. Marketing communications are subject to applicable law and separate choices.

If you separately opt in to SMS, Trouvaille Med Spa may send appointment/customer-care and/or promotional messages for the categories you select. The choices are separate and optional; you may select either, both, or neither. Promotional consent is not a condition of treatment or purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help or call (708) 966-0788. Mobile information and SMS opt-in data and consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. Messaging providers may process information solely as needed to administer the program on our behalf. Standard SMS/MMS is not a secure messaging channel and may reveal your relationship with Trouvaille Med Spa or health information to others with access to your device or account. Availability, Errors, and Changes to the Services

We may update, modify, suspend, restrict, or discontinue all or part of the Services subject to law. We do not guarantee uninterrupted, secure, error-free, current, complete, or universally available Services. We may correct errors, inaccuracies, or omissions, including product descriptions, ingredients, prices, availability, promotions, or shipping information, subject to law.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, CONTENT, PRODUCTS, USER CONTENT, AND OTHER MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, AND UNINTERRUPTED OPERATION. SOME LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE LIMITED BY LAW.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TROUVAILLE MED SPA, CHICAGO CENTER FOR FACIAL PLASTIC SURGERY, S.C., AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM THE SERVICES, PRODUCTS, CONTENT, ORDERS, OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, TOTAL LIABILITY FOR A CLAIM ARISING FROM THE SERVICES, PRODUCTS, CONTENT, ORDERS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE PRODUCT OR ONLINE SERVICE GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS ($100). THESE LIMITATIONS APPLY TO ALL LEGAL THEORIES. NOTHING LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Trouvaille Med Spa, Chicago Center for Facial Plastic Surgery, S.C., and their affiliates, officers, directors, employees, contractors, service providers, licensors, and agents from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your misuse of the Services, violation of these Terms or law, User Content, or infringement of another person’s rights. We may assume the exclusive defense of a covered matter, and you agree to cooperate.

Suspension and Termination

We may suspend, restrict, or terminate access; refuse service; cancel orders; remove User Content; or close an account where appropriate, including for violation of these Terms, fraud, unauthorized activity, misuse, or legal risk. You may stop using the Services at any time. Provisions that by their nature should survive will survive, including intellectual property, User Content licenses, disclaimers, liability limits, indemnification, dispute resolution, governing law, and general terms.

Dispute Resolution and Governing Law

Informal Resolution

Before starting a formal legal claim, contact us at info@trouvailleillinois.com with your name, contact information, a description of the dispute, and the resolution requested. We will use reasonable efforts to respond and attempt to resolve the matter.

Illinois and United States

These Terms and related disputes are governed by the laws of the State of Illinois and applicable United States federal law, without regard to conflict-of-law principles.

Before filing a lawsuit, the parties will make a good-faith effort to resolve the dispute through the informal process above. Any claim may be brought only in a court with jurisdiction over the parties and the dispute. Nothing in these Terms limits any non-waivable right or remedy under applicable law.

Changes to These Terms

We may update these Terms. We will update the effective date or provide other notice as required by law. Changes are effective when posted unless another date is stated. Continued use after the updated Terms become effective means acceptance; if you do not agree, stop using the Services.

General Terms

These Terms, together with referenced policies and additional terms, form the agreement regarding the Services. If a provision is invalid or unenforceable, it will be enforced to the maximum extent permitted and the remainder will stay in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without written consent. We may assign them as part of a merger, acquisition, reorganization, asset sale, corporate transaction, or operation of law.
